B - General Terms Relating to Platform

Platform Services for Transactions and Service Support

The Platform is an electronic marketplace and intermediary that facilitates various services. It offers trading partners a platform to advertise, exhibit, and offer motor vehicles for sale to buyers. It also enables buyers to accept offers and make payments for the purchase of motor vehicles listed on the Platform. Additionally, the Platform provides services to facilitate engagement between buyers and sellers in commerce. The Platform may also offer additional services at the discretion of Benimcars. Benimcars reserves the right to add, modify, or remove any Platform Services without prior notice. Any changes in terms, pricing, or the introduction of new services will be included in these Terms of Use. If you choose to avail yourself of any additional services, you agree to sign additional contracts as prescribed by Benimcars. You will be notified of any modifications to the Platform Services, and your access to those services will be adjusted accordingly, particularly if you choose to avail new Platform Services. The terms of the new Platform Services will be stated in these Terms of Use, which will be periodically updated to reflect the changes. It is important to note that the Platform acts solely as a facilitator for transactions between you and registered trading partners. The agreement for the sale of motor vehicles and any support services provided by registered trading partners are strictly bilateral contracts between you and the registered trading partner. Benimcars is not a party to these contracts. Benimcars does not independently verify the credentials of registered trading partners or guarantee the accuracy of their business descriptions, authorizations, offerings, pricing, location, contact details, and other information provided by the trading partners. The information is provided by the respective trading partners, who are responsible for its accuracy and completeness. Benimcars assumes no responsibility or liability for such information. The Platform displays the list prices of motor vehicles as instructed by the registered trading partners. Similarly, the Platform displays approximate costs for support services provided by trading partners. It is important to understand that the approximate cost of services is indicative and not an actual estimate. The actual fees charged by each trading partner may vary, and the fees can differ between trading partners based on factors such as the type and extent of services required, labor costs, and the cost of replacement parts. The total price indicated on the Platform for a seller support service includes the items described for that service (excluding taxes and other applicable charges under the law). However, it may not include additional services that may be required upon availing the seller support service. In such cases, the registered trading partner, based on their instructions, will discuss any change in scope and fees, which will be communicated to you. Once you have booked a seller support service through the Platform, it cannot be canceled or modified by you. If a registered trading partner cancels a service booking made by you through the Platform, Benimcars will refund all amounts collected on behalf of the registered trading partner within 5-7 working days of such cancellation. The registered trading partner is solely responsible for honoring the seller support services they provide. Benimcars will not be responsible or liable for the genuineness, quality, completeness, delays, or cancellations of seller support services booked through the Platform. Benimcars will not be liable for any offers, discounts, or service packages communicated by the registered trading partner, nor for any misconduct or fraud committed by the registered trading partner, its employees, or representatives. Benimcars does not provide any guarantee or security regarding the provision of seller support services by the registered trading partner. You can conduct searches on the Platform to find motor vehicles. The search results are derived from an algorithm that considers various factors, including customer reviews and feedback, pricing, and other criteria specified by the customer. Benimcars has no control over.
